§ 11.02. Department of administration [Public Utilities Commission].

  • (a)

    The public utilities commission is in charge of the water and light utilities and any other utilities that may hereafter be acquired by the city. The public utilities commission shall be composed of five (5) members. One (1) member may be a rural consumer of the utility services, notwithstanding any ordinance or charter requirement limiting membership on boards and commissions to city residents. The members of the commission shall be appointed by the mayor for a term of three (3) years. Their appointment shall be confirmed and their salary fixed by the council. No member shall be reappointed who has served five (5) three-year terms. Three (3) members shall constitute a quorum to conduct business.

    (b)

    A maximum of ten (10) percent of the gross income of the public utilities commission may be transferred annually to the general fund provided that such transfer does not impair present obligations and only if debt service and proper reserves for bonded indebtedness will not be impaired by such transfers. Once its annual budget has been adopted, no other transfers may be made without public utilities commission approval. No other loans, grants, or transfers shall be made from any utility funds to any non-utility fund without prior approval of the public utilities commission.

    (c)

    The public utilities commission shall:

    (1)

    Recommend candidates to the city administrator for appointment as the director of public utilities from those recruited by the city administrator with the assistance of the public utilities commission.

    (2)

    Develop qualifications and job descriptions for the director of public utilities.

    (3)

    Delegate the day-to-day operation of the utilities to the public utilities director.

    (4)

    Develop policies, procedures, and plans to serve as guidelines to the public utilities division, in the performance of its tasks and roles.

    (5)

    Formulate policies, procedures, and plans consistent with the overall goals and objectives of the city as determined by the council.

    (6)

    Recommend to the council all agreements and contracts.

    (7)

    Approve purchases of materials, supplies, services, and equipment used in the operation and maintenance of the public utilities division, where such items have received prior approval through budgetary process, subject to the following:

    a.

    The commission must comply with uniform purchasing procedures when competitive bids are required.

    b.

    Follow the same guidelines for purchasing as provided by law and city procedures.
