§ 15-1. Curfew for minors.

  • (a)

    It is unlawful for any person fifteen (15) years of age or younger to be or loiter upon the streets or public places between the hours of 10:00 p.m. and 5:00 a.m. on Sunday, Monday, Tuesday, Wednesday, or Thursday, or between the hours of 12:00 midnight and 5:00 a.m. on Friday or Saturday. It is unlawful for any person aged sixteen (16) or seventeen (17) to be or loiter upon the streets or public places after 12:00 midnight, except that this hour is extended to 1:00 a.m. on weekends. This subsection curfew shall not apply to any students who are lawfully attending, going to or returning from school, church, or community-sponsored athletic, musical, or social activities or events.

    (b)

    It is unlawful for any parents, guardians, or other person having the legal care or custody of any minor person under the age of eighteen (18) years to allow or permit such person to be or loiter upon the streets or public places after the hours designated in subsection (a) unless such minor is accompanied by a person of lawful age who is in charge of such minor person.

    (c)

    It is unlawful for any person operating, or in charge of, any place of amusement, entertainment, or refreshment or other place of business, to allow or permit any minor person to be or loiter in such place after the applicable hours designated in subsection (a) unless such minor is accompanied by a person of lawful age who is in charge of such minor person.
